1. Scope & Acceptance
These Terms & Conditions ("Terms") govern all orders placed through the NooirSound online store at www.nooirsound.com. By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
These Terms apply to all customers worldwide. Additional rights may apply depending on your country of residence — including statutory consumer rights that cannot be waived by contract.

3. Products & Contract Formation
The display of products on our Site does not constitute a legally binding offer, but rather an invitation to purchase. A binding purchase contract is formed when:
- You add item(s) to your cart and click the order button
- You complete payment
- We send you an order confirmation email
We reserve the right to cancel any order at our discretion, for example in cases of pricing errors, stock unavailability, or suspected fraudulent activity. In such cases, you will be notified promptly and receive a full refund.
Product images are for illustrative purposes only. Actual products may vary slightly in appearance due to manufacturing tolerances or screen color settings.
4. Prices & Taxes
- All prices are displayed in USD and are inclusive of all applicable fees unless otherwise stated.
- Shipping is free on standard orders unless otherwise noted on the product page.
- NooirSound operates under the German small business regulation (§ 19 UStG) and does not charge VAT. German VAT does not apply to your order.
- US customers may be subject to state and local sales tax depending on their shipping destination and applicable nexus rules. Any applicable taxes will be displayed at checkout.
- Orders shipped from China may be subject to US customs duties and import taxes, which are the responsibility of the customer. See our Shipping Policy for details.
5. Payment
We currently accept the following payment methods:
- PayPal
- Credit Card (Visa, Mastercard, American Express)
- Klarna (Buy Now, Pay Later)
- Any additional methods listed at checkout
Payment is charged immediately upon completion of your order. All transactions are processed securely. NooirSound does not store your full payment details.
By providing your payment information, you represent that you are authorized to use the payment method and that the information you provide is accurate.
6. Shipping & Delivery
All orders are shipped from our fulfillment center in China.
- Processing time: 1–3 business days after payment confirmation
- Estimated delivery (US): 6–10 business days after dispatch
- Worldwide delivery: 8–18 business days depending on destination
Delivery times are estimates only and are not guaranteed. Delays may occur due to customs processing, carrier delays, or circumstances beyond our control. We will notify you by email if a significant delay is expected.

7. Order Cancellations
- Orders may be cancelled within 24 hours of placement for a full refund.
- After 24 hours, your order may already be in processing or dispatched. In that case, our Return & Cancellation Policy applies.
- To cancel, contact us immediately at support@nooirsound.com with your order number.
8. Returns & Refunds
We offer a 30-day return window for most items. Items must be unused, in original condition, and in original packaging.

EU Customers: You retain your statutory 14-day right of withdrawal under EU Consumer Rights Directive 2011/83/EU, as detailed in our Return & Cancellation Policy.
9. Retention of Title
All goods remain the property of NooirSound until full payment has been received and cleared.
10. Warranty & Liability
Product Warranty
NooirSound products are covered by a 12-month limited warranty against manufacturing defects from the date of delivery. This warranty does not cover:
- Damage caused by misuse, accident, or unauthorized modification
- Normal wear and tear
- Cosmetic damage that does not affect product functionality
To make a warranty claim, contact us at support@nooirsound.com with your order number and photos of the defect.
Limitation of Liability
To the fullest extent permitted by applicable law:
- NooirSound's total liability to you shall not exceed the purchase price of the product in question.
- We are not liable for indirect, incidental, special, consequential, or punitive damages of any kind.
- We are not liable for damages resulting from misuse, improper installation, or use contrary to product instructions.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
US Customers: Some states do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such states, our liability is limited to the greatest extent permitted by law.
11. Intellectual Property
All content on www.nooirsound.com, including but not limited to text, images, logos, and product descriptions, is the property of NooirSound or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from our Site without our prior written consent.
12. Privacy
Your use of our Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Site, you consent to the data practices described in our Privacy Policy.
13. Dispute Resolution
For US Customers:
We encourage you to contact us first at support@nooirsound.com to resolve any disputes informally. We will make every effort to resolve your concern within 10 business days.
If a dispute cannot be resolved informally, you agree that any legal action shall be subject to the governing law stated in Section 15 below. Nothing in these Terms prevents you from pursuing claims through your applicable state consumer protection agency or small claims court.
For EU Customers:
The European Commission provides an online dispute resolution platform available at: https://ec.europa.eu/consumers/odr/
We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, but we are committed to resolving all customer complaints directly and promptly.
14. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. For US consumers, mandatory consumer protection rights under applicable US federal and state law remain unaffected and take precedence where required by law.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
